Oren Eskelsen: You can't get arrested dear for not divorcing. As the other lady said, courts will determine what rights are handed down. It will come down to the most responsible and that is able to offer the child more at the time. They will take many things into consideration. Usually the children stay with mom, unless the court feels she is unfit or unable to care for them and has some stability. I heard in our State or at least my city, that even if one doesn't agree to a divorce, the other can proceed with it, and after a certain amount of time it can be granted. It happened with my Aunt. The rights of a father is determined by the court and if there is any reason for safety issues pertaining to the children than you should state them in you case.
